Terms and Conditions • This offer is available if you have purchased a HCL Desktop or Laptop preloaded with genuine Windows Vista Home Premium or Windows Vista Business Edition between June 26th, 2009 and January 31st 2010. • Windows 7 upgrade pack shall be dispatched to you by courier at no extra charge withing 8 Weeks of general availability of Windows 7 in India. The date of actual dispatch may vary depending on various factors including product availability and product supplies. • This offer is valid for Consumer and SMB customers only. In case of SMB customer, maximum number of up-gradation is up to 20. • HCL reserves the right to require additional proof of eligibility prior to dispatch of the upgrade. • Offer void where prohibited or restricted by law. The Offer can be withdrawn or suspended without notice. • The Offer is Limited to one upgrade redemption per qualifying new PC. Your upgrade software will be in the same language and the comparable edition as the preloaded version of Windows Vista Home Premium or Windows Vista Business Edition that you licensed on the qualifying new PC. • The upgrade software is only available on DVD media. A DVD-ROM drive is required to install the upgrade software. • In no event shall HCL be liable to the Customer or any other party, whether in contract, tort or under any other legal or equitable theory (including strict liability) for any indirect, incidental, exemplary, punitive, special or consequential damages, including without limitation, loss of business, profit, revenue, data, or programs, loss of deliverables, or any and all other damages or losses. • HCL’s sole responsibility shall be to deliver the upgrade software and does not give any undertaking or guarantee for either the software, its compatibility with the system or adaptability or suitability to your requirements. Any additional support such as installation or up gradation, unless otherwise agreed, shall be provided by HCL on a paid basis. • The courts at New Delhi shall have exclusive jurisdiction for any claims or disputes arising of this Offer. **************End of Terms & Conditions*************
